PARENT & PLAYER AGREEMENT

This is an Agreement to participate in a competitive baseball program. By signing this Agreement you are consenting to be bound by the conditions set forth in this Agreement, including the requirement to pay fees associated with participation in the program as listed on this website.

TIBURONES Baseball strives to provide opportunities for higher skill-level development, competition, and commitment to the game of baseball. Participation in the team requires commitment and dedication from all participants and parents. As a member of Tiburones Baseball, my player and I will abide by the following rules and requirements:

  • Make all reasonable effort to be on time and attend scheduled events including practices, games, and tournaments.

  • Provide coaches with advance notice if unable to attend an event.

  • Treat teammates, coaches, umpires, and opponents with respect at all times as outlined in the Tiburones Baseball Code of Conduct.

  • Come prepared with a good attitude ready to work hard and have fun.

All decisions regarding playing time, playing position(s), and any other aspect of competition are made at the sole discretion of the team coach. If you have questions with respect to these items, you can request a discussion with the team coach. All decisions made by the coach regarding playing time and position(s) are final. No player or parent is entitled to a certain minimum or equal amount of playing time or entitled to play any particular position. All decisions made by the coach(es) will be based upon his or her judgement about what is best for the team given the circumstances such as league play versus competition, playoff game versus pool play, injuries, etc. Playing time is determined by attendance, attitude, effort, performance, athlete potential, current team need, future team need, and is left solely to the discretion of the coach. Coaching decisions are not up for debate or question. It is the athlete’s responsibility to ask the coach how they can improve to get more playing time. Players will be expected to play any position to benefit team performance and personal growth.

Absent in case of an emergency, you must inform your coach if you are going to miss practice or a league game. Absent in a non-emergency, if you are not going to be able to participate in a tournament, you must notify the coach at least THREE weeks in advance. A certain minimum number of players is required to play in leagues and tournaments. If a player fails to show up to play when planned upon, then that adversely impacts the team’s ability to participate in events and may necessitate getting guest players. Prior notice is key to accommodating these situations. There is no credit or refund for missing a tournament, game, or other event.

Termination of Membership

It is understood that players and/or parents may decide not to continue play with Tiburones Baseball. Issues may arise at different times because of many reasons such as, but not limited to, a family moving, player injury, or joining a different team. Such a decision or event does NOT relieve the parent from the financial responsibility agreed upon under this Agreement. By signing this Agreement you are making a commitment with other members of the team to share in associated costs and fees for participating in different events. These events require payment up front and are non-refundable to the team. Your decision to terminate your participation with Tiburones Baseball is a voluntary choice and the balance of your fees will be due according to this Agreement and outlined on this website. You are required to pay all fees including tournaments reguardless of whether or not you playing.

Explanation of Fees

Tiburones Baseball fees cover registration fees for varying tournaments, such as RMSB or SU Baseball, as well as different leagues. Team jersey, hat, coaching and facility fees are also be built into these fees. Details and what is included will be outlined and described in teams meetings, product descriptions and on the team groupme chat.

Fees / Deposits / Registrations

Depending on tournament and league fee payments requirements, deposits may be required to ensure a spot on the team. Tournament and/or league waivers, copy of birth certificate, etc. are often required for entrance into different tournaments and leagues. These must be accomplished according to dates requested on this website. Payments can be made through the website store.

In the event your account becomes delinquent, you agree to pay all past due fees and any acquired collection fees, court costs, and attorney’s fees incurred in enforcing this Agreement.

***Fees are non-refundable and no credit shall be given.***

Team Communications

The GroupMe app will also be leveraged for communication and can be downloaded for real-time communication and updates. GroupMe is a communication platform that falls under guidelines established by the Tiburones Baseball Code of Conduct.

TIBURONES BASEBALL AND DASNI BASEBALL TRAINING ARE NOT RESPONSIBLE FOR ANY INJURY (OR LOSS OF PROPERTY) TO ANY PERSON SUFFERED WHILE PLAYING, PRACTICING OR IN ANY OTHER WAY INVOLVED IN TIBERONES BASEBALL/ DASNI BASEBALL TRAINING LLC FOR ANY REASON WHATSOEVER, INCLUDING ORDINARY NEGLIGENCE ON THE PART OF THE NORTHERN UTAH SPORTS ACADEMY, OR ITS AGENTS, EMPLOYEES, SPONSORS, VOLUNTEERS, THE OWNERS AND LESSORS OF THE PREMISES AND ALL OTHERS WHO ARE INVOLVED.

In consideration of my being allowed to participate in any way in Tiburones Baseball/ Dasni Baseball Training related events and activities, I hereby release and covenant not-to-sue Tiburones Baseball/ Dasni Baseball Training or any of their employees, instructors or agents, from any and all present and future claims resulting from ordinary negligence on the part of the Tiburones Baseball/ Dasni Baseball Training, or others listed for property damage, personal injury or wrongful death, arising as a result of my engaging in or receiving instruction at the Tiburones Baseball/ Dasni Baseball Training programs and activities incidental thereto, wherever, whenever, or however the same may occur, I hereby voluntarily waive any and all claims resulting from ordinary negligence, both present and future, that may be made by me, my family, estate, heirs, or assigns. Further, I am aware that sports can be vigorous, involving at time severe cardiovascular stress and violent physical contact. I understand that sports involve certain risk, including but not limited to death, serious neck and spinal injuries resulting in complete or partial paralysis, brain damage and serious injury to virtually all bones, joints, muscles and internal organs, and that equipment provided for my protection may be inadequate to prevent serious injury. I further understand that baseball involves a particularly high risk of ankle, knee, head, and neck injury. In addition, I understand that participation at Tiburones Baseball/ Dasni Baseball Training involves activities incidental thereto, I am voluntarily participating in this activity with knowledge of the danger involved and hereby agree to accept any and all inherent risks of property damage, personal injury, or death. I further agree to indemnify and hold harmless the Tiburones Baseball/ Dasni Baseball Training and others listed for any and all claims arising as a result of my engaging in or receiving instruction in the Tiburones Baseball/ Dasni Baseball Training activities or any activities incidental thereto, wherever, whenever, or however the same may occur.

 

I have private insurance coverage for the participant. In absence of this information, I assume all liability for such expenses. I understand that this waiver is intended to be as broad and inclusive as permitted by the laws of Utah and agree that if any portion is held invalid the remainder of the waiver will continue in full legal force and effect. I further agree that the venue for any legal proceeding shall be in the State of Utah.

The following e-signature guarantees Tiburones Baseball/ Dasni Baseball Training that I have read and fully understand the Disclaimer and agree to the terms and conditions stated.

CODE OF CONDUCT

​

You and your child are choosing to participate in the Tiburones Baseball program designed to train and develop young athletes. Baseball, especially Tiburones Baseball, is meant to be fun, challenging, and full of opportunities to grow, interact positively with others, and learn habits to be successful, both on and off the baseball field.

​

Actions by parents, fans, players, coaches, and spectators will have a profound influence on children and others. Many children are quitting baseball today because much of the fun is taken away by adults. Your role as a participant with Tiburones Baseball has a significant impact on the organization and those involved and, most importantly, on the children who participate. Children are always watching and taking notice of our actions, words, and behaviors for better or for worse.

The following standards of behavior, which will be implemented immediately, must be understood, accepted, and adhered to for participation in the program:

​

  • I will do my best to make baseball fun and fulfilling for my child.

  • I, as well as my guests, will exhibit good sportsmanship at all times by positively supporting all players, coaches, umpires, league & tournament officials, and other parents at all trainings, practices, and games.

  • I, as well as my guests, will not engage in any kind of unsportsmanlike conduct with any players, coaches, umpires, league & tournament officials, or other parents such as, but not limited to: taunting, booing, refusing to shake hands, verbally or physically making threats, or using profane language or gestures.

  • I will keep winning in its proper perspective understanding that the development and confidence of young athletes is much more important than the outcome of a game or tournament. The focus should always be on training and practice to promote development, discipline, and determination to improve.

  • I will promote a sports environment that is conducive to health and training success. Healthy habits lead to better training and success on and off the field. This includes proper sleep and rest as well as a healthy diet. There is zero tolerance for players using substances while participating with Tiburones Baseball.

  • I will promote and establish a positive student athlete balance for my child. Academics are vital to success on and off the field and deserve the necessary time and effort to be successful. Success in the classroom translates to success while training, practicing, and on the field.

  • I will refrain from coaching my child or other players during games and practices, unless I am one of the official coaches of the team.

  • I will ask my child to treat other players, coaches, parents, fans, umpires, and officials with respect regardless of race, sex, creed, or ability.

  • I will not encourage any behaviors or practices that would endanger the health and well-being of the athletes.

  • I will learn the rules of the game and the policies of the leagues or tournaments entered. I will teach my child to play within those rules and to resolve conflicts respectfully, without resorting to hostility or violence.

  • I, as well as my guests, will respect the coaches and their authority during games. I will not confront coaches on the playing or practice field, in the dugout, or in front of players or other parents.

  • I will wait 24 hours after a game, practice, or event where concerns or conflicts arise to request a discussion with a coach. If, after that time period a discussion is still desired, the request should first be directed to Coach Chales Dasni.

  • I, as well as my guests, will accept all decisions of umpires and league/tournament officials as being fair and judged with the best of their ability, regardless of whether I agree with the call or decision.

  • I will not post or comment on any posts any negative, passive aggressive words or information on social media, websites, or communication platforms that reference other players, coaches, parents, teams, or organizations.

 

***Tiburones Baseball is has a zero tolerance policy with regards to this Code of Conduct***

I have read and reviewed the Player/Parent Agreement,  Code of Conduct and Disclaimer outlined above and have discussed it with my player. By filling out my name and signing below, I realize that, if at any time, my behavior becomes non-compliant with any of these standards I will be subject to actions that could include, but are not limited to:

  • Verbal and/or written warning from Tiburones Baseball

  • Ejection from games or practice sites and/or facilities

  • Suspension from participation in Tiburones Baseball either for a period of time and/or indefinitely
